Happy Holidays to terminal cancer patients, From the Goldbergs
November 28th, 2007 | Posted by CTLPaul and Kirsten Goldberg don’t think it’s enough to have conspired with FDA insiders to sabotage Provenge so that terminal Cancer Patients can’t enjoy the benefit of Provenge and enjoy a quality holiday season with their families, now they seek to fight CareToLive, a not for profit corporation, in the courts.
If you forget, the Goldbergs are the husband/wife team who produce a questionable journal from their basement. This so called “journal” contains articles about current topics in health care. The thing is that neither of the Goldbergs are doctors and they have no doctors on staff. It has been reported that they sit in the basement of their home and discuss things with their neighbors and then write about them in their non peer journal.
Why do people subscribe to this? People subscribe to this because Paul Goldberg is known to regularly have inside information from the FDA. He has become a news outlet for some in the FDA. To put it bluntly, Mr. Goldberg profits from inside information from the FDA. This is not a new thing it has been going on since FDA, OOD division head, Richard Pazdur, through his attorney Sam Turner, leaked the Imclone (Eribitux, Martha Stewart) news to Goldberg.
People in Washington monitor the Goldbergs’ publication, not for good medical analysis, but rather as a window into the FDA.
As many of you know the Goldbergs were also the ones that leaked the Provenge letters Scher, (Alison Martin) Hussain, and Pazdur’s good friend Fleming, wrote to the FDA. This again was a purposeful “leak” as strategized and designed by Dick Pazdur at the FDA, the same person who leaked other inside information to the Goldbergs.
In an effort to obtain evidence of these letters, which at that time the FDA was saying they never received (they have changed their story now), to present at CareToLive’s injunction hearing, subpoenas were issued (prior to any stay of discovery in the case). To avoid service of a subpoena, the Goldbergs hired an attorney and told that attorney not to accept service on their behalf. And, they told their attorney that they were leaving town and could thus not be served. So CareToLive was running around trying to serve the Goldbergs in an effort to obtain the full copies of the Scher, Hussain and Fleming letters and the Goldbergs were dodging service. It was, and is believed, that the means of communication of these letters and the identity of those that gave them to the Goldbergs will be important evidence against the Defendants in the case and would impeach the FDA.
The name of the Goldbergs’ non peer journal has not been stated here because it is believed that they made their court filing in part to get publicity and CTL does not wish to help him get publicity (they have gotten a lot of publicity from this matter already). Remember their subscribers are largely investors or others who want inside FDA information that they know the Goldbergs get through their sources inside the FDA.
It was not enough for the Goldberg’s just to have posted letters fraught with misinformation and deception prior to the FDA decision on Provenge, which would have helped the Provenge conspirators sink Provenge. It was not enough that they helped pressure the decision makers at the FDA to deny Provenge even after the experts told them it should be approved. It was not enough that Mr. Goldberg has done his part to deprive AIPC patients of a safe and effective treatment in the past, now he wants to dance at their funerals as well. While Mr. Goldberg could be working with CTL and helping to expose the wrongdoing at the FDA, he does not want that because his own personal financial interests are best served if he keeps his FDA insiders in place.
Mr. Goldberg, who is presumably friends and/or an associate of Howard Scher, is no different from Mr. Scher in that they both think it is okay to profit at the expense of the patients who are now dying.
Profiting from inside information from the FDA is unlawful yet we all know how on the ball the DOJ and the SEC have proven to be in that regards. Goldberg has built a career on unlawful leaks.
By filing a motion for sanctions, the CareToLive pro bono counsel must now take time and resources to fight that motion in court. CTL and counsel must expend time and resources to fight the Goldbergs instead of concentrating on the patients. No directors of CTL or their counsel receive any money for the time and effort they put into advocating for Provenge for the Patients. While CareToLive fights for the terminal patients, the Goldberg’s fight CareToLive. Now time and resources must go towards fighting Paul Goldberg. Such a waste that Mr. Goldberg now qualifies as a Grinch seeking to steal Christmas from the AIPC patients.
Happy Holidays to the cancer patients from the Goldbergs. Having not done enough harm to you previously, we now seek money from you and would like to cause injury to the people who are trying to help you. That’s the holiday spirit guys! Maybe the Goldbergs just want the money so they can send a nice Christmas bouquet of flowers to the patients in the hospital suffering from prostate cancer.
